RWR prevented from moving charters during Legacy lawsuit
Rick Ware Racing is legally prevented from selling its charters per a court order issued Friday.
Legacy Motor Club, which is suing Ware over a charter sale, asked for a preliminary injunction to ensure Ware did not transfer or sell the charters before the litigation is resolved. The injunction request was filed by Legacy Motor Club after T.J. Puchyr told the Associated Press in June that he had entered into an agreement with Ware to buy into the race team.
A trial date has been set for January 26, 2026.
The initial lawsuit filed by Legacy Motor Club on April 1 alleges that Ware backed out of a charter sale. There is also a dispute over which charter was to be in the transaction. Ware has two charters, assigned No. 27 and No. 36.
Ware filed a countersuit against Legacy Motor Club in early June. In doing so, it was revealed that at the crux of the dispute between the two sides is “controversy between the parties regarding the correct sale charter and the terms under which that charter would be conveyed. The Agreement entered between the parties identified Charter No. 36 as the sale charter for a purchase prize of $45 million.
“Legacy has repudiated the Agreement by … claiming the Agreement was actually for Charter No. 27, seeking to enforce a sale of Charter No. 27 (including but not limited to filing a lawsuit), and refusing to perform the parties’ agreement for sale of Charter No. 36. This is a substantial alteration and breach of the parties’ agreement.”
Ware fields one entry in the Cup Series with a charter. The other charter is currently being leased to RFK Racing, and the two organizations have a deal for Ware to lease both of its charters for one year each.
