Ward family: "This matter is not at rest"

Although Tony Stewart has been cleared of criminal negligence in the death of Kevin Ward Jr. by a New York grand jury, the late sprint car racer's family said in a statement that it is not satisfied with the grand jury's conclusion and that it intends to "pursue all remedies," suggesting that it will pursue civil litigation against the NASCAR star.

"Our son got out of his car during caution when the race was suspended," the statement read. "All the other vehicles were reducing speed and not accelerating except for Stewart, who intentionally tried to intimidate Kevin by accelerating and sliding his car toward him, causing the tragedy."

District Attorney Michael Tantillo revealed after the grand jury's decision was announced that toxicology reports had determined that Ward Jr. was under the influence of marijuana on the night of the incident. Tantillo said the level of marijuana in Ward's system was high enough to impair judgment.

"The focus should be on the actions of Mr. Stewart," the Ward family's statement added. "This matter is not at rest and we will pursue all remedies in fairness to Kevin."
